Legal argumentation in sentences as a guarantee of the principle of motivation guaranteed in the Constitution of the Republic of Ecuador.
Abstract
The objective of the research was to analyze the importance of legal arguments in court decisions to guarantee the principle of motivation in accordance with Article 76 of the Constitution of Ecuador. The methodology developed includes a legal-constitutional analysis approach, the method used is analytical-descriptive. Regarding the techniques, documentary analysis was used. The conclusions show that the ruling of the Constitutional Court of Ecuador in case 1158-17-EP/21 redefines the guarantee of motivation, establishing more rigorous guidelines that surpass the traditional motivation test.
