Exegetical evaluation of superior structures in criminal types.
Abstract
This study brings together various prominent criminal types, focusing on main axes: 1. Relevant interpretation; 2. Social assessments; 3. Cultural changes and evolution; 4. Justice and equity in the application of criminal law. Its objective was limited to exhaustively examining the fundamental structures of certain criminal types, since their operationalization is comparable to all violations of substantive criminal law. Methodologically, it was based on a subjective ontological relationship and critical rationalism. The findings indicate that normative indicators are essential to understand and apply criminal types, underlining that understanding the social context is crucial to ensure an equitable and fair interpretation, thus protecting human rights.
