Abstract

In this work, a panorama is shown about the best known models of constitutional interpretation. It faces the originalism represented in those who are in favor of preserving the constitutional text, in spite of the passing of time and those who prefer a dynamic relationship. The constitutional control in relation to the organ has not been alien to the litis and we reviewed the confrontation carried out by Schmitt and Kelsen, where Kelsen prevailed; which means judicial constitutional control. It deals with the limits of judicial constitutional interpretation, the constitutional reform and its mechanisms, where finally reference is made to the Ecuadorian case, concluding with a brief review of Simón Bolívar and the need for militancy in virtue of rights.
